I have represented hundreds of clients in criminal, regulatory and disciplinary cases. All of my work now is through direct access and I have a formidable track record and reputation developed through hard work.

I have represented clients in the criminal courts in just about every offence which exists from minor public order offences up to an including murder although fraud has accounted for the vast majority of work over the last 4 years. However I don’t treat any case or client differently and remain well aware that the repercussions for each client is all that matters to them.

I moved into licensing, disciplinary and regulatory work by accident after clients wanted me to continue to represent them in front of their regulatory bodies or the local authority. Over the last five years these have turned into my main areas of practice having built up a strong practice and loyal client following.

Regulation

I have been involved in regulatory and disciplinary work for many years and represented hundreds of clients.

Most of my clients now approach me from the outset to assist with case strategy and advice. Many of them do not even know if they are going to be charged or brought before any tribunal.

I also currently act for several businesses in an advisory capacity to try and avoid having issues in this field.

As can be seen from the other sections on my profile I have dealt with all of the following:

Professional disciplinary and other healthcare related hearings – I have represented solicitors, accountants, police officers and healthcare professionals including those appearing before the NMC, GMC/MPTS or HCPC. I have also advised and acted in proceedings brought in the Care Standards Tribunal. I am the founder of separate specialist websites relating to nurses, doctors and other healthcare professionals and advise regularly through them.

Local Authority licensing cases – I have represented landlords in relation to HMO (houses of multiple occupancy) matters, landlords and business owners in relation to alcohol and entertainment licences, premises licences and personal licences. I have also acted in cases involving trading standards, health and environment cases and high profiles cases prosecuted by the Environment Agency.

Business Fraud and Corruption cases – I have represented those accused of breaches of company law and associated regulations as well as those facing prosecution by SFO (Serious Fraud Office) or FSA (Financial Services Authority) as well as HMRC (Her Majesty’s Revenue and Customs). I have been at the centre of some of the biggest cases last year brought by the Health and Safety Executive.

I know how these departments and organisations work and I know how to challenge them or negotiate with them.

Professional Discipline

I have also advised and acted in proceedings brought in the Care Standards Tribunal. I also currently act for several businesses in an advisory capacity to try and avoid having issues in this field and have spent time specifically advising in relation to CQC inspections. I have been central to setting up a mock inspection team which assists organisations worried about regulatory breaches or professional standards assessments.

Healthcare

Through my work in regulatory and disciplinary law I have represented large number of medical professionals before their regulatory bodies in either first instance proceedings or appeals including:

  • General Medical Council (GMC) at MPTS;
  • Nursing and Midwifery Council (NMC),
  • Health and Care Professions Council (HCPC), and
  • General Pharmaceutical Council (GphC).

With close connections to individuals in the NHS generally and NHS England I have spent considerable time around medical professionals and see the incredibly hard work that they do and how exposed they are to claims and allegations.

Because of my experience in the criminal courts and other adversarial tribunals my special expertise is at contested hearings. However good strategy has meant that more often my clients are not even reaching that stage of proceedings.

I have dealt with:

  • Registration and licensing Getting registered, Specialist and GP registration, Relinquishing registration [voluntary erasure], Relinquishing your licence to practice and Restoration to the register.
  • Fitness To Practise The investigation process, Warnings, Interim Orders, Health, Competence, Misconduct, Substantive hearings, Sanctions and mitigation, Appeals.
  • Revalidation Advice for doctors, nurses and midwives without a designated body, Advice for those with a designated body.

I have also assisted with CQC mock inspections for many parties in both the NHS and those in the private sector and have my own team currently carrying out mock inspections for clients.

Health and Safety

As part of my experience in criminal defence and regulatory work I have advised and represented many individuals and companies in relation to health and safety matters including but not limited to:

  • General regulatory and legal advice on enforcement in health and safety;
  • Corporate manslaughter and gross negligence manslaughter including criminal liability;
  • Advice and representation following work related deaths including inquests;
  • How to deal with and respond to prohibition and improvement notices;
  • Advice and representation during investigation by the Health and Safety Executive (HSE), Environmental health locally and nationally, the police and Office for Rail Regulation (ORR). 
  • Advice in relation to invitations to be interviewed under caution by relevant departments.
  • Advice in relation to HSWA and associated health and safety regulations including appropriate risk assessment and regulations relating to landlords' requirements.

I have represented various parties in the Magistrates’ Court and the Crown Court for all matters. I am also able to deal with such cases at inquest where appropriate.

In recent years my health and safety experience has coupled with my licensing expertise in relation to the hotel and leisure industry. However, I also have experience in both the retail trade and construction industry having advised two major and nationally known London based construction firms and one major retail cosmetic brand outlet.

Licensing

I have dealt with all forms of licensing work from taxi drivers to SIA to alcohol and entertainment licences. I have worked in licensing in one form or another for over twenty years having managed pubs, clubs and hotels myself. This experience is unparalleled among barristers and gives my clients a huge advantage when dealing with Local Authorities and Regulators.

I have detailed and expert knowledge of the Licensing Act 2003 and its provisions and all other relevant licensing legislation including those relating to taxi licensing and SIA accreditation and registration.

Over the last few years I have represented hundreds of clients before Councils and Local Authorities or their regulatory bodies in relation to licensing reviews and appeals.

I advise on and assist in proper pre-application strategies, drafting applications for a licence, handling of objections, full negotiations with the relevant authorities and preparation for hearings including sub-committees.

I have represented applicants and licensees at sub-committee hearings and at all other hearings. I can assist in making sure you and your case are properly prepared to maximise your chances of success in avoiding suspension or revocation. I have dealt with personal as well as premises licences.

I regularly assist those facing a review and possible revocation. I can advise on your approach to the review and draft the necessary paperwork/application. My forte however is on advising on strategy and the best way to present your case. An integral part of this will be making sure the application is the strongest it can be. My experience places my advocacy at the heart of representation at any hearing.

My experience is most appreciated however at appeals where my understanding of strategy and advocacy are integral. I draft any and all necessary paperwork, assist in explaining court procedure and prepare clients for court. I also handle any negotiations on your behalf and if needed prepare your case to maximise the chances of success. I have had considerable success in securing agreement with Local Authorities and regulators through negotiation saving the time and expense of contested hearings.

Criminal Defence

In recent years my focus has moved more toward regulatory offences and fraud.

Last year I defended one director of a nationally recognised waste disposal operator in a case where 8 defendants were charged and the total damage caused was in excess of £9 million according to the Environmental Agency. We secured a very favourable outcome with the EA through negotiation and without having to give evidence.

Last year I also defended the only defendant out of 9 to be acquitted in a commercial scale “boiler room” fraud at Southwark Crown Court. All others were convicted in a fraud totalling £23 million and received immediate sentences of 3-7 years imprisonment.

Business Crime and Fraud

My criminal defence practice over the last few years has shifted toward business crime and fraud offences and I have acquired considerable expertise and success in this field.

I have been involved in all of the following: diversion fraud, fraudulent trading, advance fee fraud, mortgage fraud, money laundering, MTIC and carousel fraud, VAT fraud, revenue and tax fraud, directors disqualification, restraint orders, pension fraud, confiscation orders, insurance fraud, SFO investigations and prosecutions among many others. I have also acted for many facing trading standards investigations or charges with or without duty evasion.

It is in such cases where my background and experience in business comes to the fore. Having held positions of senior financial position both within organisations and for my own businesses I am fast to understand processes and the allegations.
