Care Quality Commission next phase of regulation

The Care Quality Commission (CQC) has set out details of how it will regulate during the next phase of the coronavirus starting from 6 October.

We have previously written about the CQC’s ‘managed’ return to inspections.  Following on from this, the CQC’s Chief Inspectors have now issued a joint statement on the commencement of its transitional regulatory approach, starting with adult social care and dental services starting on 6 October.

Transitional regulatory approach

The CQC describes this regulatory approach as “flexible and builds on what we learned during the height of the pandemic”. The key components of the transitional regulatory approach are:

  • A strengthened approach to monitoring, with clear areas of focus based on existing Key Lines of Enquiry (KLOEs), to enable us to continually monitor risk in a service
  • Use of technology and our local relationships to have better direct contact with people who are using services, their families and staff in services
  • Inspection activity that is more targeted and focused on where we have concerns, without returning to a routine programme of planned inspections.

The CQC will not be returning to business as usual for inspections.  The transitional regulatory approach means that the it will adopt an “Emergency Support Framework (ESF) as an additional monitoring tool to support structured and consistent conversations with providers.”

This in essence means, CQC inspectors will substitute on-site inspections with monitoring and reviewing information from “all available sources, collecting further information where necessary.”  CQC inspectors will review the monitoring this information and existing streamlined set(s) of Key Lines of Enquiry (KLOEs) to make their judgement.  The CQC has been clear that “an inspector’s professional judgement will remain part of how we monitor risk.”

Challenging inspection reports

The CQCs capacity to re-rate services is limited.  It said in the joint statement:

“As well as having limited ability to carry out on-site inspections, our ability to re-rate services is also limited by our published methodologies for rating and reporting on services. Although we’ll be able to re-rate a service in a limited number of cases, this varies in practice between the sectors we regulate.”
